Your Safety Net: Withdrawal and the FernUSG
A distance degree or distance course starts with a contract, and that is exactly where your rights live. For approval-required distance education, Germany's Distance Learning Protection Act (FernUSG) applies. It was created to protect participants from unfair contract constructions, and it works at two points: at entry via the withdrawal right, and at exit via statutory cancellation options.
The withdrawal right allows you to dissolve the contract shortly after conclusion without giving reasons. The period only starts running once you have been properly instructed about your right of withdrawal. So if you have just signed and are having doubts, first check whether the withdrawal period is still open. It is the simplest and cheapest exit.
Cancelling a Distance Degree: Periods and Form
If the contract is already running, cancellation applies. The FernUSG provides that a distance education contract can first be cancelled at the end of the first half-year after conclusion, with six weeks' notice. After that, cancellation is possible at any time with three months' notice. Contracts may contain more favourable rules, but not worse ones: clauses that undermine these statutory rights are invalid.
In practice this means: cancel in writing, record the date, and have receipt confirmed. Also check what your contract says about form and who the cancellation must be addressed to. Until it takes effect, instalments usually continue; afterwards the payment obligation ends. One important distinction: cancelling with the provider and exmatriculating at the university are two separate steps, and both need to be completed.
An honest look before cancelling still pays off. If the problem is a packed life phase, a leave semester or a switch to a part-time model is often the better path, because enrolment and completed coursework remain untouched. If it is the provider, the path more likely leads to switching.
Switching Providers Without Starting Over
The biggest misconception about switching: that everything achieved so far is lost. The opposite is the norm. You can submit passed modules with ECTS to the new university for credit transfer. The receiving university checks module by module whether content and level are equivalent, and takes over what fits. The closer the new programme is to the old one, the more is typically recognised.
The sensible order: first clarify the credit question with the university you want to move to, ideally with module descriptions and a grade overview in hand. Only once it is clear how many ECTS and semesters will be accepted, cancel the old contract. That way you avoid a gap in which you pay twice or stand without a study place.
